ICARE PIAWE Review and Remediation Program

ICARE NSW is inviting injured workers who received weekly workers compensation payments between October 2012 and October 2019 in NSW to come forward if they believe they may have been underpaid their weekly entitlements by the Workers Compensation Insurer.

ICARE is reviewing all weekly payments made during that period and recalculating the PIAWE (Pre-Injury Average Weekly Earnings) rate to determine if there was an underpayment. If ICARE determines that the Workers Compensation Insurer underpaid, you may be eligible to receive back payments of weekly compensation

The pre-injury average weekly earnings (PIAWE) is the income that an injured worker earned over the 52 week period prior to the injury. The calculation of PIAWE is difficult and the insurers have made many errors when making this determination.

ICARE has found that many workers have not been paid their correct weekly payments because of the complex process required to determine PIAWE.

There has been an estimate that workers have been underpaid $80 million and iCare now wants to ensure that workers have been paid correctly.

I engaged with Garling and Co to assist me for my weekly payment dispute with the insurance. I was upset with Natasha, as she didn't prepare me to the worse outcome or told me about the kind of... negotiation in the hearing. I assumed that as a Lawyer she should have an experience with the process or the way to solve the case. Even though I asked her what should I do or what would be happened in the hearing a week before but she didn't mentioned anything, and told me not do anything. But in the hearing she and the Barrister only gave me less than 5 minutes to make decision and pushed me to accept the disappointed outcome and what she said in the hearing totally different with what she said earlier.
